The Terms and conditions stipulated below govern your purchase of cars through dealers or test driving via our website which is an online platform for new car buyers to test drive one owned by another user at home or convenient location to get a real world owner's review of car, compare offers and get great deals on new car purchase from main dealers and by engaging in our services confirms you have read and agreed to be bound by them.

Please read these Terms and conditions carefully before purchasing Cars or making a booking for a Test Drive through our website.

The Cars are provided and sold by dealers.

By registering as an host, as a user looking to buy a car or Driver or Dealer ,you are entering into a contract with DriveTry Limited, and agreeing to abide by these terms and conditions (the “Terms”).

DriveTry makes available an online platform for new car buyers to test drive one owned by another user at home or convenient location to get a real world owner's review of car, compare offers and get great deals on new car purchase from main dealers.

DriveTry reserves the right to modify these Terms from time to time at its sole discretion. If we modify these Terms, we will either post the modification on the site or otherwise provide you with notice of the modification. The amended terms and conditions will enter into force midnight on the day being posted on the Site and will govern the contractual relationships between DriveTry and users of this site and all after that date. Any amendments that affect the terms and conditions applicable to Bookings shall only apply to Bookings entered into after the amended terms and conditions come into force.

Any user who does not accept any amended terms and conditions should cease to use the Site after the date on which the amended terms and conditions come into force, save to the extent necessary to complete any Booking entered into prior to that date.


NOTE: We do not own, sell cars, hire, manage and/or control Cars or other types of vehicles or offer transport or travel services but only enable car dealers to provide you with offers or other users to provide Test Drive services through our website. These Terms shall not create any rights that shall be enforceable by anyone else other than You and Us. If any part of these Terms and Conditions is found to be unenforceable, this will not affect the validity and enforceability of the remaining document.
DEFINITIONS
“Buyer”, means the Organisation or person who purchases a Car (s) from the Dealer. In all cases, “We”, “Us”, “Our”, refers to DriveTry Limited, includes agents, employees and directors. “Seller” means the group of dealers offering Cars for sale to the Buyer. “Terms” means these terms and conditions.
SCOPE AND PURPOSE
These ‘Terms and Conditions’ govern your use of our services to purchase Cars through the website DriveTry.co.uk and engaging in these services you accept this Disclaimer in full. Whenever a User decides to purchase or lease a car from a car dealer through the Website, a new Agreement between the potential buyer or lessee shall be entered into with the respective car dealer. DriveTry Limited shall not be privy to that Agreement. DriveTry Limited through its website offers an easy, convenient and trusted way of purchasing, test driving or leasing a brand new car. The customer shall sign up for free and can thereafter book a test drive, at their convenience and within their location (Refer to Brochure).
REQUIREMENTS
Each user looking to purchase a car shall be required to create an account with the required information. The potential buyer/lessee shall post on the Website their requirements and preferences for the car they wish to purchase/lease. Car dealers shall post Cars matching the stipulated requirement(s) for the potential buyer to consider. This information shall include but not limited to the price, delivery time among other key details. All Users must provide information which is up to date and true to the best of their knowledge.
TEST DRIVES
A buyer/ potential buyer may book a test drive and also choose a convenient time and location for the testing to take place. The Buyer shall be automatically matched with a test DriveTry Host within their proximity who owns the same model/make of the car the potential buyer seeks to buy. In the instance the test drive request is accepted, the Host shall be notified in order to take his/her car to the buyer/ potential buyer’s chosen location at the agreed time. NOTE: Hosts are not sales people but ordinary people/Owners who sign up to allow customers to test drive their cars. Hosts shall be paid for each test drive they provide whether or not the potential buyer makes a purchase. Payments maybe revoked on the discretion of DriveTry if a host is deemed not to have provided the service require of a customer raises a dispute. During the test drive, the Car Owner and the potential buyer are required to be present.
REQUIREMENTS OF THE HOST (CAR OWNER)
Be registered through creating an account and submitting all the relevant information as required; Provide a description on the vehicles and its salient features the car/features to the buyer/ potential buyer and gives them his/her personal experience/review on owning the car; As per our eligibility criteria, all cars on the service must be safe to drive, in good condition, clean and tidy. Where a Host hands over their Car to a Driver, they shall ensure that it is roadworthy and generally suitable condition and meets all legal standards stipulated under the necessary laws before the test drive takes place.
TEST DRIVE BOOKINGS/CANCELLATION
All Bookings shall be made via the website as required under the booking icon. A booking may be cancelled any time before an acceptance is made. Additionally, no one is obligated to accept any request for a Booking made. An acceptance shall create a legally binding contract between the Parties.Cancellation of bookings shall only be done through the booking cancellation icon on the website. Where a cancellation is approved, the remitted fee shall be refunded. Where a refund is not due, users will be notified. Host/Driver Lateness Policy We encourage buyers and hosts to get in touch with each other directly to ensure a smooth test drive process, especially at the beginning or end of a booking and if for any reason any user is late. A user may cancel if either partyis late for more than 15 minutes resulting in the host not being paid or no refund of test drive fee if the buyer depending on who was late. We therefore encourage early communication to reschedule to prevent the inconvenience. DriveTry does not accept any liability as a result of either party being late. Traffic Fine Policy The Driver is responsible for all traffic fines during the test drive (such as speeding tickets, red light contraventions, congestion charges, toll charges or moving violations) incurred during the test drive. Hosts and Drivers should work together to resolve these fines quickly. If a host receives notification of a traffic fine or similar offence incurred during a test drive, they should first contact the Driver via their DriveTry profile or by the telephone number provided at the time of booking to make them aware of the fine and give them the chance to pay it directly or transfer it into their name. The host should provide the Driver with the details of the charge and instructions for payment. If a traffic fine is obtained during the test drive then the DriveTry Driver is liable for a additional £10 fine (per PCN) that will be transferred to the host for their time taken to resolve the issue. If the Driver fails to pay or transfer the fine within 7 days of notification from the host, then the host may email DriveTry a copy of the violation notification and any further details. DriveTry will then help resolve this fine with the Driver. In this event, Driver will be liable for a £50 administration fee on top of the cost of the fine.
Appeals and Arbitration Process
In the event that an host or Driver is deemed liable for a fine imposed by a third party such as the Police or a local authority, they will be informed by email and their card debited. This sum is automatically debited from their card but can be challenged by return email or phone. DriveTry reserves the right to request further documentation. DriveTry will consider the User's appeal and any relevant information provided, but has sole discretion in accepting or refusing the User's challenge.
INSURANCE
Before the test drive, the buyer is required to obtain comprehensive insurance through DriveTry’s preferred insurance provider. DriveTry may cover the cost of insurance depending and will notify the buyer if an insurance payment is required before booking is completed. The customer will thus be fully insured (comprehensive cover) to drive the car. Insurance We may require you to download the insurance provider mobile app or use their website to ensure you are covered. DriveTry will not be privy to the insurance policy and does not accept any liability and as such requires the host to ensure the buyer has obtained the required insurance cover before handing over their car.
OFFERS /DEALS
Offers/Deal made or received through the website do not represent a contractual obligation to purchase or lease a car. It is only an invitation to treat thus the car dealer is not obligated to sell or lease a car for the stipulated price or to sell/lease a car at all. If interested in entering in a Contract, the potential buyer/lessee shall get in touch with the car dealer. From there a Contract may be entered into depending on the Agreement between the Parties. New vehicles shall be sourced through certified official dealership partners and Clients can choose to pick up or have their cars delivered.
FINANCING
DriveTry may provide financing options by introducing buyers to approved financial partners. In the event of this, the finance agreement will be between the buyer and the finance company and DriveTry will not be privy to the agreement or accept liability.
PART EXCHANGE

Part exchange is also acceptable to ensure buyers/potential buyers have good value for their old cars.

OBLIGATIONS /RESPONSIBILITIES
A User is NOT allowed to; upload, post, host, or transmit unsolicited email, SMSs, or spam messages; transmit worms or viruses or any code of a destructive nature; violate the Terms and Conditions herein; violate any applicable federal, state or local laws or regulations; or violate or otherwise infringe upon the trademark, copyright, patent, trade secret, or any other rights of any person, or entity. We reserve the right, but have no obligation, to monitor and/or mediate disputes between the Users. Users are solely responsible for the content or information they transmit to others. We reserve the right to monitor use of the Service to ensure compliance with these Terms of Service and where necessary, take appropriate action including, but not limited to, suspension or cancellation of your account. LICENSE TO USE THE SERVICE Subject to your continued compliance with this Terms of Service Agreement and any other relevant policies, by using Our website you are granted a non-exclusive, non-transferable, non-sub-licensable, revocable and limited license to access. Additionally, you agree not to use the Service for any other purpose except as authorized. INTELLECTUAL PROPERTY POLICIES (COPYRIGHTS, PATENTS, TRADEMARKS) Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved. Trademarks: Nothing in these Terms of Use will be construed as granting the User any right or license to use any trademarks, service marks or logos displayed on our website.

Any link to an external website is for your general reference and convenience and is not meant in any manner to be a validation or referral.
SECURITY
We shall at all times use industry standard practices to safeguard the confidentiality of your personal identifiable information which must be protected against loss and unauthorized access. We shall endeavor to apply all commercially viable security techniques to protect such data from unauthorized access by others.
INDEMNITY
The User agrees to indemnify and hold DriveTry Limited, its employees, officers, directors and agents, harmless from any claims, liabilities and expenses, including reasonable attorney’s fees, resulting from the User’s use or misuse of the service.
APPROPRIATE REMEDY
If a User is dissatisfied with any portion of the service, or with these Terms and Conditions, their sole and exclusive remedy is to discontinue using the service.
LIMITATION OF LIABILITY
IN NO EVENT SHALL EITHER PARTY HEREIN BE LIABLE TO THE OTHER PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, BUSINESS INTERRUPTION, LOSS OF OR UNAUTHORIZED ACCESS TO INFORMATION, DAMAGES FOR LOSS OF PROFITS, INCURRED BY THE OTHER PARTY ARISING OUT OF THE SERVICES PROVIDED UNDER THIS TERMS AND CONDITIONS, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES.
TERMINATION OF Account
Termination of any User's Account is without prejudice to any of rights or obligations (including the obligation to pay any money and the right to receive any money) that accrue under any Booking that was agreed prior to such termination. DriveTry shall be entitled to suspend or terminate the Account of any User, in its discretion and without liability to the User, with or without cause, with or without prior notice and at any time, decide to limit, suspend, deactivate or cancel a User’s Account of DriveTry.
ENTIRE AGREEMENT AND MISCELLANEOUS PROVISIONS
These terms and conditions, and the pages on the Site to which these terms and conditions refer, constitute the entire agreement between DriveTry and the Users. These terms and conditions, together with the details of each Booking, constitute the entire agreement between DriveTry and the Users and between the Users in relation to that Booking. If any provision (or part of any provision) of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions will continue in force without being impaired or invalidated in anyway. No delay by any party in enforcing their rights shall prejudice or restrict those rights. No party shall be deemed to have waived their rights under these terms and conditions because of their failure or delay in exercising that right. No User may assign, transfer and/or subcontract all or any of any their rights and/or obligations under these terms and conditions or in relation to any Booking and any attempt on any User's part to do so is void.
RIGHTS OF THIRD PARTIES
A person who is not a party to these terms and conditions or any Booking or any other contractual relationship contemplated by them has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any provision of these terms and conditions or any Booking or any other contractual relationship contemplated by them.
JURISDICTION AND GOVERNING LAW
These terms and conditions and each Booking shall be governed by and interpreted in accordance with the laws of England. The courts of England shall have exclusive jurisdiction in respect of any claim or dispute which may arise in connection with these terms and conditions or any Booking or in connection with and/or arising from any use of the Site.
CONCERNS
If any User has any concerns about any material whatsoever which appears on the Site, they may contact support@DriveTry.co.uk If any User believes that any communication made through or on the Site infringes any legal rights that any they may have or is in breach of any of these terms and conditions or knows of or suspect any unauthorised posting of or attempt to post any communications, that User may notify us with specific details by email at the following address: support@DriveTry.co.uk Each DriveTry User agrees to comply with all reasonable requests from DriveTry, the police, or any statutory or regulatory authorities in identifying any unauthorised users of the Site.
General Conduct
All Users must: Provide accurate, valid and complete information on their profile and keep this up to date at all times. Not post offensive, defamatory or false claims on reviews. Never publicly share, post online or misuse other User’s contact information.
DriveTry Responsibility
DriveTry endeavours to only allow safe Drivers and cars to use the service. To minimise the risk of damage, only safe (vetted/approved with a safe record) Drivers can become Drivers. DriveTry will use reasonable efforts to undertake online verification of all participating vehicles and Drivers, using a number of third party databases including the DVLA to ensure Drivers meet our Driver Eligibility Criteria and vehicles are not stolen or tainted with illegality or fraud. DriveTry does not undertake any safety checks of the private vehicles offered for hire by DriveTry Car hosts on the website. It is the responsibility of the DriveTry Car host to ensure compliance with the Vehicle Eligibility Requirements and for the Driver to be satisfied this responsibility has been discharged. DriveTry will not be responsible for incidents caused by test drives. DriveTry Car hosts and Drivers are fully responsible for their own conduct - we will do our best to police and remove offending parties from future participation. The DriveTry experience We require every test drive to comply with out code of conduct with underlying principles to treat each user with respect and each test drive should comply with legal road limits, driving at safe speeds and in a manner that does not cause damage to the vehicle. DriveTry are able to remove Users from their website at their absolute discretion. We reserve the right to debit registered banking cards on booking confirmation or later and to impose fines in line with our Conduct Policies at our absolute discretion. DriveTry has sole discretion in suspending Users from the service and reserves the right to require proof of identity or a security deposit when reinstating Account. Cancellation and Compensation Policy If a User creates or accepts a booking on DriveTry, they commit to honouring it. The cancellation fines below are designed to minimise inconvenience caused to the disappointed party and are automatic. However, we encourage hosts and Drivers to resolve cancellation disagreements between themselves. In these cases, both parties must inform DriveTry via email or phone so that the cancellation fine may be waived or refunded.
